PRESTIGE ATTIRE TERMS & CONDITIONS
By hiring from Prestige Attire Group trading as Prestige Attire, you are accepting and consenting to the practices in these terms of use and our Privacy Policy (available at www.prestigeattire.com.au) Prestige Attire reserves the right to change these Terms from time to time at its sole discretion. Nothing in this agreement is intended to have the effect of contracting out of any applicable provisions of the Australian Consumer Law.
By placing a booking with Prestige Attire, you acknowledge that you have read, understood and agreed to the following Terms & Conditions.
1. BOOKINGS & PAYMENT
1a) All hire orders must be paid in full before the garment is collected or received.
1b) Once an order has been placed and confirmed, the booking cannot be changed or transferred to another garment or customer.
1c) The garment remains the property of Prestige Attire at all times.
1d) The garment hire is solely for use by the person named on the booking.
2. HIRE PERIOD & RETURNS
2a) The standard hire period is a maximum of four (4) days, unless otherwise agreed to by Prestige Attire.
2b) The garment must be returned by the agreed return date and time.
2c) If the garment is not returned within the agreed rental period, a late fee of $15 per day may apply until the garment is returned.
2d) Customers are responsible for the garment from the time it is collected or received until it has been returned to Prestige Attire.
3. GARMENT CARE
3a) Customers must take reasonable care of all hired garments.
3b) Garments must not be washed, dry-cleaned, ironed, steamed, altered or repaired by the customer unless approved by Prestige Attire.
3c) Any fashion tape or temporary adhesive should be carefully removed before returning the garment.
3d) Customers should take reasonable precautions to avoid damage or staining from fake tan, makeup, perfume, food, drinks or other products.
3e) Hired garments may show minor signs of previous wear due to their nature as rental garments.
4. DAMAGES & ISSUES
4a) Customers must inspect the garment when it is received or collected.
4b) If the garment is damaged, defective or incorrect, the customer must contact Prestige Attire immediately so the issue can be assessed and resolved.
4c) Customers must notify Prestige Attire as soon as possible if a garment becomes damaged, lost or stolen during the hire period.
4d) If a garment is returned with damage, excessive staining or requires repairs or additional specialist cleaning, the customer may be responsible for the reasonable cost of repairs or cleaning.
4e) If a garment is returned in a non-hireable condition, is lost, stolen or damaged beyond reasonable repair, the customer may be required to pay the liability or replacement cost stated on their hire agreement.
5. CANCELLATIONS
5a) Once an order has been placed, the booking cannot be changed.
5b) If a customer cancels their hire more than 21 days before the beginning of the hire period, they will receive a refund of 50% of the order price.
5c) The 50% cancellation fee reflects the time and costs involved in preparing and reserving the garment, as well as the potential loss of other bookings.
5d) If a customer cancels 21 days or less before the hire period begins, no refund will be provided.
5e) Failure to collect the garment or choosing not to wear the garment does not automatically entitle the customer to a refund.
6. REFUNDS
6a) Where a refund has been approved, Prestige Attire will notify the customer once the refund has been processed.
6b) Approved refunds will be returned to the original payment method.
6c) Please allow up to 10 business days for the refund to appear in your account.
6d) Refund processing times may vary depending on the customer's bank, card provider or payment service.
6e) If more than 15 business days have passed since the refund was approved and it has not been received, please contact prestigeattireau@gmail.com.
7. INCORRECT, DEFECTIVE OR UNAVAILABLE GARMENTS
7a) If Prestige Attire is unable to provide a booked garment due to damage, a previous customer failing to return it, or the garment otherwise becoming unavailable, Prestige Attire will contact the customer as soon as possible.
7b) Depending on the circumstances, Prestige Attire may provide an appropriate replacement garment, store credit or refund.
7c) If the customer receives the incorrect garment, they must contact Prestige Attire as soon as possible so the issue can be resolved.
8. RETURNS & NON-RETURNABLE PURCHASES
8a) Hired garments cannot be returned for a refund simply because the customer changes their mind or chooses not to wear the garment.
8b) Where Prestige Attire sells products separately from its dress-hire service, certain products may not be eligible for return, including personalised or custom-made items, personal care or hygiene products and gift cards.
8c) Sale items are not eligible for change-of-mind returns, except where required by Australian Consumer Law.
8d) Customers should contact Prestige Attire if they are unsure whether a particular purchased item is eligible for return.
9. CLEANING
9a) Prestige Attire manages the normal cleaning of garments following each hire.
9b) Customers must not attempt to clean or dry-clean the garment themselves.
9c) Where additional cleaning is required because of excessive staining or damage beyond reasonable wear, the customer may be charged the reasonable additional cleaning cost.
10. CUSTOMER RESPONSIBILITY
10a) The customer must keep the garment in their possession and control throughout the hire period.
10b) The customer must take reasonable steps to protect the garment from loss, theft or damage.
10c) The customer must notify Prestige Attire of any damage or issues as soon as possible.
10d) The customer must return the garment by the agreed return date and time.
10e) The customer must not make any unauthorised alterations to the garment.
10f) The customer must follow any care, collection and return instructions provided by Prestige Attire.
11. PRESTIGE ATTIRE CANCELLATIONS
11a) Prestige Attire may cancel a booking if the garment becomes unavailable, damaged or cannot reasonably be supplied.
11b) If Prestige Attire cancels a booking and cannot provide a suitable alternative, the customer will receive an appropriate refund for the affected hire.
**12. PRICE MATCH
12a) Prestige Attire offers price matching on eligible garment hires where the same garment is available for hire at a lower price from another Australian dress-hire business.
12b) To qualify for a price match, the competing garment must be:
- The same designer, style and colour.
- The same or equivalent size.
- Available for the same requested hire dates.
- Offered for a comparable hire period.
- Publicly advertised and available to book at the time the price match is requested.
12c) Customers must provide Prestige Attire with reasonable evidence of the competitor's advertised price, such as a current website link or screenshot.
12d) Price matching applies to the competitor's standard advertised hire price and does not apply to:
- Discount codes or promotional codes.
- Flash sales or temporary promotional offers.
- Membership, loyalty or referral discounts.
- Store credit or gift voucher offers.
- Clearance or closing-down sales.
- Pricing errors.
- Private rentals, marketplace listings or peer-to-peer hire platforms.
- Interstate or international businesses where the hire conditions are not reasonably comparable.
12e) Any additional charges, including shipping, delivery, insurance, cleaning or other compulsory fees, may be considered when determining whether the competitor's total hire price is lower.
12f) Price match requests must be made before the Prestige Attire booking is completed and paid for. Price matches will not normally be applied retrospectively to existing bookings.
12g) A price match cannot be combined with another Prestige Attire discount, promotional code or special offer unless otherwise approved by Prestige Attire.
12h) Prestige Attire reserves the right to verify the competing offer and decline a price match where the competitor's garment, hire period, availability or booking conditions are not reasonably comparable.
12i) Any price match offered is subject to garment availability and these Terms & Conditions.**
13. AUSTRALIAN CONSUMER LAW
13a) Nothing in these Terms & Conditions is intended to exclude, restrict or modify any rights or remedies that cannot legally be excluded under the Australian Consumer Law.
